Justices take up heart of health care overhaul law

WASHINGTON (AP) ? The Supreme Court is taking up the key question in the challenge to President Barack Obama's historic health care overhaul: Can the government force people to carry insurance or pay a penalty?

The justices hear extended arguments on that topic Tuesday. It's the linchpin of the law's aim to get medical insurance to an additional 30 million people, at a reasonable cost to private insurers and state governments.

Virtually every American will be affected by the outcome, due this summer in the heat of the presidential and congressional election campaigns.

The administration says Congress has ample authority to impose the requirement that most people carry insurance or pay a penalty. Twenty-six states and a small business group trying to get the law struck down call the insurance requirement an unprecedented power grab by Congress.

They say that not even decades of high court rulings that endorsed an expansive view of congressional authority can support the health care law.

If upheld, the law will force dramatic changes in the way insurance companies do business, including forbidding them from denying coverage due to pre-existing medical conditions and limiting how much they can charge older people.

The law envisions that insurers will be able to accommodate older and sicker people without facing financial ruin because its most disputed element, the insurance requirement, will provide insurance companies with more premiums from healthy people to cover their increased costs of care.

White House press secretary Jay Carney, traveling Tuesday with Obama in South Korea, reiterated the administration's contention that the health care law is constitutional, noting that the individual mandate provision had support among Republicans. However, Carney said, "The president feels that this is something for the court to decide, not for us to weigh in on directly."

The law also dramatically expands the state-federal Medicaid program for low-income Americans, with the federal government covering almost all the additional costs.

A 19th century law bars tax disputes from being heard in the courts before the taxes have been paid. The law could apply to the health care case because the insurance requirement doesn't kick in until 2014 and any penalties will be paid along with federal income tax on returns due by April 2015.

Solicitor General Donald Verrilli Jr., defending the health law, urged the court to focus on what he called "the issues of great moment" at the heart of the case. The states and the National Federation of Independent Business also want the court to go ahead and decide on the law's constitutionality without delay.

Administration officials involved with the defense and implementation of the health care law, Attorney General Eric Holder and Health and Human Services Secretary Kathleen Sebelius, were in the courtroom Monday. Republican Sen. Jeff Sessions of Alabama and Florida Attorney General Pam Bondi also were in the crowd that filled the courtroom's 400 seats.

Outside the packed courtroom, marching and singing demonstrators on both sides ? including doctors in white coats, a Republican presidential candidate and even a brass quartet ? voiced their eagerness for the court to either uphold or throw out the largest expansion in the nation's social safety net since Medicare was enacted in 1965.

Republican presidential candidate Rick Santorum declared anew that GOP front-runner Mitt Romney has no standing to challenge Obama on the law since Massachusetts passed a somewhat similar version when Romney was governor. "If you really want Obamacare repealed," Santorum said outside the court, "there's only one person who can make that happen."

Later Monday, Romney said again he would repeal the law, calling it an unconstitutional power grab.

Fannie, Freddie faulted for spending on conference

WASHINGTON (Reuters) - A federal watchdog faulted Fannie Mae and Freddie Mac, the mortgage finance companies propped up with taxpayer funds, for "questionable" spending on a mortgage industry conference last year, in a report released on Thursday.

Almost half of the $600,000 that the two companies spent for a conference held by the Mortgage Bankers Association in October "was of questionable value," the inspector general for the companies' federal regulator said.

The inspector general cited $140,000 spent to help sponsor the conference, saying it "did not find sufficient justification" for the sponsorship. It also cited the $140,415 spent to host dinners and business meals, saying the companies could have accomplished the same amount of business at a "substantially lower cost."

The inspector general at the Federal Housing Finance Agency also faulted the companies, the two largest sources of U.S. housing finance, for acting without FHFA's approval.

In January, the FHFA directed Fannie Mae and Freddie Mac to stop spending money on conference sponsorships and said coverage of employees' food expenses should be reined in, according to the report.

FHFA has tightened its scrutiny of Fannie Mae and Freddie Mac's expenditures, which have been criticized by lawmakers.

Fannie Mae and Freddie Mac defended their spending on the conference. They told the inspector general that they scheduled more than 200 meetings with customers, including small lenders and financial institutions involved in mortgage lending, as well as mortgage service providers.

The annual Mortgage Bankers Association event attracts thousands of industry executives and others who work in the mortgage industry. Ninety Fannie Mae and Freddie Mac employees attended last year, the report said.

Both Fannie Mae and Freddie Mac said it was "entirely within the authorities delegated" to each of them by the FHFA to make the decision to attend the conference and sponsor it. FHFA had a similar view at the time, the report stated.

The watchdog did say, however, that the $256,458 in travel-related costs and registration fees was comparable to expenses that would be allowable for federal employees.

The inspector general said FHFA still needs to look more closely at how much Fannie Mae and Freddie Mac spend on travel and entertainment, and look for ways to curtail future spending.

"FHFA should ensure that (Fannie Mae and Freddie Mac) conduct a comprehensive review of their travel and entertainment policies, and revise them," FHFA Deputy Inspector General George Grob said in a memo accompanying the report.

An FHFA official said in a written response to the report that the agency agreed with its recommendations and is taking steps to change the way it monitors spending at the two firms.

Army reviewing traumatic stress diagnostic practices

WASHINGTON (Reuters) - The Army has started a system-wide review to ensure its mental healthcare facilities are not engaging in the "unacceptable" practice of considering treatment costs in making a diagnosis, Army Secretary John McHugh told a U.S. Senate hearing on Wednesday.

Lieutenant General Patricia Horoho, the Army surgeon general, initiated the review in response to the discovery that hundreds of soldiers being treated for post-traumatic stress disorder had their diagnoses reversed after being seen by psychiatrists at the Madigan Army Medical Center in Washington state.

The medical center is located at Joint Base Lewis McChord, the home base of Staff Sergeant Robert Bales, who is suspected of killing 16 people, including nine children, in a shooting rampage in Afghanistan this month.

Bales was on his fourth deployment to a war zone in the past 10 years. His civilian lawyer told Reuters last week that PTSD would likely be part of the defense.

PTSD is a huge issue for the Defense Department. A recent Army study estimated as many as 20 percent of the more than 2 million U.S. troops who served in Iraq and Afghanistan could suffer from post-traumatic stress disorder. Cost of care could range between $4 billion and $6.2 billion, it said.

The Army is looking at whether doctors at the medical center were influenced by the cost of PTSD diagnosis in terms of pensions and other benefits. One psychiatrist said the cost to taxpayers was $1.5 million over the lifetime of a soldier on medical retirement, the Seattle Times reported.

The review being carried out by the Army inspector general aims to ensure that standardized diagnostic procedures are followed by all psychiatrists "and equally important that fiscal considerations are not in any way a part of the evaluations," McHugh said. "It's simply unacceptable."

Referring to Bales, Representative Bill Pascrell, founder of a U.S. congressional task force on brain injuries, told reporters he wanted to "cradle this soldier in our arms" while condemning his actions until it could be determined what happened to him and whether he was properly tested and treated.

Bales had received a traumatic head injury and lost part of a foot during previous deployments in Iraq. The incident raised questions about the stress of repeated deployments, but McHugh said four was not uncommon.

"We have in the military writ large over 50,000 folks in uniform who have had at least four deployments," McHugh told members of the defense panel of the Senate Appropriations Committee.

'VERY CONCERNING'

Patty Murray, a U.S. senator from Washington state, told McHugh it was "very concerning" that 40 percent of the service members with PTSD who were seen by psychiatrists at Madigan "had their diagnosis changed to something else or overturned entirely."

"What it says is that over four in 10 of our service members - many of whom were already being treated for PTSD - and were due the benefits and care that comes with that diagnosis had it taken away by this unit," she said. "They were then sent back into the force or the local community."

General Ray Odierno, the Army chief of staff, said the Army wanted doctors and psychiatrists to have the attitude they were "patient advocates."

"That's the mindset that we're going to work on changing - to make sure that everybody understands that," Odierno said. "We are patient advocates. We are trying to get the best for what is right for our soldiers."

But Murray said senior military leaders had been saying that since the start of the war a decade ago.

"It's really disconcerting after 10 years to find now that that has not been the case," she said.

Murray said it was important to focus on the issue system-wide to make clear that "it isn't the cost of PTSD or any mental health evaluation that is of concern to the Army. ... It is making sure that those men and women get the care."

If you want to raise your self esteem but are not having major self esteem problems, then a trip to the local library or book store may help. You could get a lot of helpful advice and recommendations, either with a live person (personal coach/groups) or with books and videos.

You may turn to books or seek professional help, but you could actually save on professional fees and the cost of a book by taking action yourself. To raise self esteem, you need to set goals for yourself and then take the necessary actions to meet these goals. Image of murdered former UNC student body president being used in India advertising

Eve Carson's student body photo (AP Photo/Courtesy of UNC, Jim Stratford)Back in 2008, the murder of University of North Carolina student body president Eve Carson made international headlines. And now, in a strange and unseemly turn of events, her official UNC-Chapel Hill photograph is being used without permission to promote a potentially disreputable company in India.

The News & Observer reports that the company Jubeerich Consultancy is using Carson's student body photo to promote their business, which bills itself as providing "overseas study opportunities and placement services."

"I'm surprised and disappointed that somebody is using Eve's image in this way," Chuck Lovelace, executive director of the Morehead-Cain Scholars Program, told the paper. "It certainly does not honor Eve or her family, and they would not want it to be used in this way."

Caron was involved with the Morehead-Cain Scholars program and Lovelace remains close to her family. In March 2008, Carson was robbed and shot to death by two men who were later convicted of murder. Jubeerich has not responded to request for comment from The News & Observer or Yahoo! News.

When the Observer contacted the company's corporate offices, an employee denied? the existence of the photograph but declined to go on record and said their manager was "on leave."

Unfortunately, UNC law professor Deborah Gerhardt tells the paper that a lack of enforcement of international copyright laws make it unlikely that anything can be done about the photo's use, which technically is the property of UNC.

"You just have to hope that people will respect the dignity of her family and her memory and understand that for people who see this in the United States, this really evokes a horrible tragedy," Gerhardt told the paper. "One would hope that they would respect that and take it down."

Easter is coming up fast and a lot of people ask me what besides bunnies make a good Easter pet.

Chinchillas make great pets. They live up to 25 years and can be very tame and friendly. They eat chinchilla pellets and timothy alfalfa. To clean their fur, they use a dust bath. When you handle a chinchilla, the oils from your hand gets on their fur. To clean their fur, you put some of the dust bath powder in a big bowl, then step back. They will roll around in the dust and kick at it. It?s very amusing. They really love that dust. In the wild, a chinchilla will usually find a dry dirt spot and they?ll roll around in that. The chinchillas love to chew. They make all kinds of chew treats. We have lots of them here at Pets A Plenty. Chinchillas also love the big wheels. They?ll run in those for hours. They also make a jumbo ball that you can put them in just like the ones hamsters use, only bigger.

I always think parakeets make great Easter pets. They are very pretty, active and love to interact with people. They are relatively inexpensive to keep too. A large bag of food will last several weeks and parakeet toys are very inexpensive.
Even the parakeet cages are reasonably priced. Some people have told me that their parakeet could talk.Usually it?s the males that are the most likely to say a few words. They aren?t as good as a parrot but it? possible to teach them a few words.

Another great Easter pet is the chinese hamster. These hamsters are small and they stay small too. They are extremely friendly.
They are known for their disposition. Very rare for them to bite. Most of the time when you pick them up, they?ll sit right on your hand
and be content to stay there. Their lifespan is shorter, usually around 2 to 3 years. These make great pets for kids. They are desert
animals so they do not drink a lot of water, so they do not produce much urine, thus the cage does not get too stinky. I?d say once a
week is all you?ll have to change their cage. You can not feed hamster seed to the chinese hamsters. They need to eat the chunk food called square meal. Seed can actually kill these little guys, so stay away from that.

Other animals that make good Easter pets are guinea pigs and ferrets. The ferrets do cost the most of all the animals I have mentioned,
however they are a real fun pet. They love to get out of their cage and play. Be sure to keep an eye on them because they are really mischievous. They will get into everything. Ferrets are all descented and neutered and spayed, but their is still a slight musky smell to them. It bothers some people and to others ,it?s no big deal. Guinea pigs are a little messy. They drink a lot so they might be a bit more smelly. Their cage might need cleaning 2 times a week. They live to about 5 years and ferrets live 7 to 9 years.

While managing 30 million Draw Something downloads, parent company OMGPOP somehow found time to produce another game.

Next week it will launch The Street, a Facebook game that looks like Farmville for hustlers.

OMGPOP CEO Dan Porter says it will be "the realist game ever on Facebook."

"Think Denzel Washington in American Gangster," he says.? In addition, The Street will feature unreleased tracks from Wu Tang Clan.

We were surprised the new game is launching on Facebook when Draw Something has been such an iPad, Android and iPhone success. Porter tells us The Street is also being developed for mobile, and that this is likely the last Facebook game OMGPOP will produce. The Street was under development before Draw Something went viral.

It's not exactly the terrain in which you'd expect to find a French estate rising like the Taj Mahal out of the Texas horizon, but in the heart of Texas, that's what you've got: The palatial digs called Champ d'Or.

The one-of-a-kind mansion sits in Hickory Creek, about a 15-minute drive from the Dallas-Fort Worth airport. Nearby, there's an extra-large Walmart, a few farms and a collection of home developments. These surroundings help make the dome-topped French estate seem more grand behind its iron gates.

Inside, the estate features interiors that mimic landmarks from around the world: A master closet designed to look like the Chanel boutique in Paris; a hall of mirrors designed like Versailles' own; a tea room mirrored after New York City's famed Tavern on the Green.

Owners Alan and Shirley Goldfield spent five years and $46 million constructing Champ d'Or -- French for "field of gold." But, -- surprise! -- when it came time to move in, the two decided that the 49,000-square-foot home was too big.

Before the exterior scaffolding was even removed, the property was placed on the Hickory Creek real estate market for a whopping $45 million.

For the past eight years, the home has been for sale with prices ranging from $72 million to its current price of $35 million. Now, however, with the owners eager to move the process along, an auction has been set for March 30 -- a growing trend among sellers of high-end properties.

In the case of Champ d'Or, the home will go to auction with a reserve of $10.3 million. But this isn't a bank auction. Run by Concierge Auctions, vice president of marketing Laura Brady likened the auction to something for a priceless piece of art or jewelry ? something so unusual it's incomparable.

"We feel like we create a transparent atmosphere of what the property is worth," said Brady. "It's only worth what someone is willing to pay, otherwise it's hard to say what a property like this is worth."

And it's true: Champs d'Or cannot be compared to anything else on the Texas real estate market or, for that matter, anything listed in the U.S.

Most significantly, the home is enormous, said Candy Evans of the Dallas real estate blog Candy's Dirt.

"You could get lost in there," she said.

While the home has six bedrooms and 10 bathrooms, it's the other amenities that put the home in a category all its own:

• Veranda with seating for 450 people.
• Ionized lap pool off the master suite.
• Master suite that includes a breakfast bar, steam room with room for 2 and a two-story Chanel-styled closet.
• Soundproof-theater room with adjacent lobby.
• Three kitchens: private, catering and staff.
• Third-floor private suite with its own dining room, living room and two bathrooms.
• Bowling alley.
• Wine room.
• Full-sized ballroom.
• Gift wrap room.
• Commercial-sized laundry room with sheet press

As Evans says, whoever lives here would have no real need to ever leave the house.

Despite the extensive detailing to the property, it hasn't been an easy sell. According to Evans, four different agents have represented the property, with each spending at least $100,000 in marketing. But what Evans believes has kept buyers away is the cost of the upkeep.

The house require a year-round staff, and currently has four people hired full-time to maintain it, Evans said. It also carries enormous property taxes and maintenance costs. In addition to a hefty mortgage of $132,677 a month, (according to Zillow's mortgage calculator and assuming a 20 percent down payment on a 30-year-mortgage on its current listing price of $32 million) Champ d'Or doesn't come cheap.

Ohio upsets Michigan 65-60 in NCAA tourney

NASHVILLE, Tenn. (AP) ? Walter Offutt got a taste for what it was like to beat Michigan while he was at Ohio State. Clinching an upset win for Ohio over the Wolverines in the NCAA tournament is just a bit sweeter.

Offutt, who ended up at Ohio by way of Wright State, grabbed a loose ball, was fouled by Evan Smotrycz and sank both of his free throws with 6.8 seconds left to preserve Ohio's 65-60 upset of Michigan on Friday night in the second round of the NCAA tournament's Midwest Regional.

"It's been an amazing journey," Offutt said. "Probably the best thing that ever happened in my life."

The No. 13 Bobcats have had quite the season, winning the Mid-American Conference tournament and a program-record 28 victories. There's still time for more great things, starting with a game against the Temple-South Florida winner Sunday.

"We're playing our best basketball of the year, no doubt about that," said Ohio coach John Groce, whose 2009-10 Bobcats squad upset third-seeded Georgetown.

Ohio had the Wolverines on their heels throughout the game, but Michigan's Trey Burke hit a 3 with 4:12 left to cut it to 63-60. But the Wolverines missed their final five shots, including four by the freshman Burke.

"We were really emphasizing (that) this doesn't have to be a 3-point game," Michigan coach John Beilein said. "Could we have gotten more open (shots)? Well, time would have told, but those were the choices he made, and we live with them."

On Burke's third miss, fourth-seeded Michigan (24-10) got the rebound but Smotrycz lost control of the ball in front of the Wolverines bench, and Offutt grabbed it.

Ohio shot 51.2 percent and held Michigan to 40.7 percent shooting, including 7 for 23 from 3-point range, typically the Wolverines' comfort zone. The Bobcats entered the tournament ranked 13th in the nation in 3-point defense, with opponents shooting just 29.6 percent against them.

"I thought our ability to defend the 3 was going to be critical coming into the game," Groce said.

The teams traded the lead three times and were tied a fourth time when Baltic spun around in the lane and hit a jumper that launched a 15-2 run for Ohio. Nick Kellogg was left open and sank a 3-pointer that made it 35-22 with 2:49 in the first half.

The Bobcats smothered the Wildcats often deadly perimeter shooting and dared them to go inside. Even though Michigan was the smaller of the two teams, it outscored Ohio in the paint 16-12 in the first half.

Hardaway Jr. managed to get 10 points by halftime, but Zack Novak, Stu Douglass and Burke, who together average 31.9 points per game, combined for just seven points.

The loss is just another NCAA disappointment for a Michigan program that hasn't been to the round of 16 since 1994 and its vacated national championship season the year before. The Wolverines are 3-9 in tournament games since then.

But it especially hurts for seniors Douglass and Novak, who helped lead the team to a three-way tie with Ohio State and Michigan State for the Big Ten regular-season championship.

"I haven't cried over a basketball game since I got knocked out in high school," said Douglass, whose 136 career games is a record for Michigan. "So that kind of paints the picture for you."
