The Listing Pictures Look Different Than The House In Real Life ...

Q: My question is this: if the photos of the inside of the house on the Realtor website do not match what you see when you go to look at the house (house was pristine on website, and trashed in real life) and the house is marked ?as is? is this not somehow misleading the buyer and is the Realtor breaking any laws?

A: Could it have been trashed after the pictures were taken?

The nicest thing to do would be to let the listing agent know about the condition of the property and take the pictures off that don?t match.

Its nice to be able to fix a problem before being ?reported.?

A: Definitely, it sounds like misrepresentation and false advertising. Laws, rules, and regulations are being broken.

Find the listing, address, MLS # and contact a local board of Realtors and make a complaint about the photos. They should be able to figure out who placed the listing and take it immediately of the website.

A: I am not an attorney so I do not have a legal interpretation but I do have an opinion!

As a Realtor? I want prospective buyers to have a realistic idea of the inner characteristics of a property. It is a waste of a buyer?s time as well as a seller?s time when there is a major discrepancy. Depending on the length of time a home has been on the market the conditions could change a bit if the seller or a tenant has moved out. And then there is the possibility the photos were taken during a previous listing and not updated.

One thing I know for sure ? it is not a good practice to have inaccurate pictures or even worse, no pictures, when you are working for the seller.

A: If the real estate agent is a Realtor member of the National Association of Realtors they are bound by a code of ethics. Does this fall under that code is another questions entirely. I suggest you call your local board of realtors and discuss the issue with them.
