It?s just fun to mention that March 15th is a Hungarian Holiday commemorating the Hungarian Revolution of 1848 and their independence from the Hasburg Empire. I just love that my book will be associated with a revolution. Even a bloodless one. I have some Hungarian in me. I can feel it.

Call it rat?ings, call it sweeps, call it bad jour?nal?ism, call it extreme left-wing pol?i?tics or polit?i?cal cor?rect?ness run amok; the sen?sa?tion?al?ist per?spec?tive is mak?ing a con?ve?nient scape?goat out of gam?ing, like it did with film, tele?vi?sion, music, and lit?er?a?ture before. The debate of ?Do vio?lent games pro?duce vio?lent gamers?? has obvi?ously been around for a long, long time. But lately we?re see?ing gam?ing being called into play as the per?pe?tra?tor in vic?tim?less crimes (actu?ally, even the word ?crimes? is mis?lead?ing in these instances, more like ?unfor?tu?nate occur?rences?), and events that wouldn?t nor?mally receive any notice what?so?ever -?that?haven?t caused any harm or peril to any?one -?are now con?nected to gam?ing in dubi?ous ways and pub?li?cized with sup?posed pub?lic out?cries of great dis?may. The fact that, with the inter?net and the right forum, every?one is a pun?dit nowa?days doesn?t help our cause as gamers any. Plenty of ama?teurs love to fuel a con?tro?versy, and hav?ing jour?nal?ists that aren?t impar?tial and haven?t checked their facts speak out against gam?ing is throw?ing addi?tional gaso?line on the prover?bial fire. But enough of the back?ground expo?si?tion and metaphors; let?s get down to brass tacks (couldn?t help myself):

• Recent high-profile release, Dead Island, received a fair amount of pos?i?tive feed?back upon its recep?tion. It also received much neg?a?tive atten?tion from the media after it was leaked that a user found the orig?i?nal name of a skill of one of the female char?ac?ters from the game. Spot?ted in the game?s orig?i?nal source code, and removed from proper retail ver?sions of the game, the skill had at one point been referred to as ?Fem?i?nist Whore? by a pro?gram?mer at the studio.
• A young man suf?fered a sud?den and unex?pected death caused by a blood clot form?ing (known as a deep-vein throm?bo?sis) in his leg due to large amounts of time spent sit?ting down, immo?bile. The rea?son? The man was a habit?ual Xbox Live player, spend?ing large amounts of time play?ing Halo?in front of his con?sole. The diag?no?sis? He was ?addicted? to videogames. The head?line? ?Xbox Tragedy?!
• Surely there?s noth?ing objec?tion?able about Por?tal 2, which is rated ?E? for ?Every?one? here in the States?! Wrong. The crime in ques?tion was an in-game series of jokes made at the protagonist?s expense; jokes about being adopted. As luck would have it, Neil Sta?ples hap?pened to be watch?ing as his 10-year old adopted daugh?ter was play?ing this game. Luck?ily, the tragedy was in large part averted (excuse me, but I can?t help a cer?tain level of deri?sion here) when he rushed to her aid and turned off the offen?sive game. The real crime here? The reporter?s rather unin?formed stance, not to men?tion her faux out?raged tone. The daughter?s reac?tion? Noth?ing!
• Cer?tainly no stranger to con?tent that pushes the enve?lope, Rockstar?s Grand Theft Auto?series made head?lines due to its Hot Cof?fee Mod ? a sim?u?lated sex scene hid?den in the game?s code (once again!), which couldn?t even be viewed by the game?play?ing pub?lic. But sure enough, if politi?cians had their say, all copies of San Andreaswould have been burnt in the pub?lic square at high?noon.

  The people?s voice of reason?

• Another one of Rockstar?s games, Bully, actu?ally cre?ated a lot of con?tro?versy before it wasever released. In an effort to get the game banned from the state of Florida, Jack Thomp?son demanded in court to receive an advance copy of the game, which the court ruled he should receive. Thomp?son had pre?vi?ously claimed (with?out any?knowl?edge of the game?s con?tent whatsoever)?that the game was a ?Columbine sim?u?la?tor? (refer?ring to the infa?mous Columbine Mas?sacre). After advance copies were played, the court ruled that the game posed no threat to soci?ety, and was allowed to ship. As a sad end?ing to this story, Thomp?son sub?se?quently turned his atten?tion towards the judge rul?ing against him, and began a cam?paign that ended in Judge Friedman?s disbarment.

The list could go on and on, but I think my point has been made. The media, who are sup?posed to be impar?tial and fair, are?quick to jump on any story that holds the poten?tial of sell?ing a pre?dis?posed point-of-view, and this is cur?rently at the expense of gam?ing as a whole. Why offer a ratio?nal, well thought-out argu?ment when a false head?line scream?ing out?rage sells? And yes, I real?ize the con?sumer is once again to blame for this. But there?s a rea?son why there was no national out?rage dur?ing the late ?80s/early ?90s, when two car?i?ca?tured plumbers with fake New York-Italian accents and han?dle?bar porn?staches had their own children?s TV show, quip?ping things like ?Trav?el?ing tomato sauce!?, ?Cracked Cal?zones!?, and other ethnically-charged allit?er?a?tions ? it?s because it was for enter?tain?ment, and nobody gave a?damn!

Every?thing is ?Peo?ple are out?raged? and ?The pub?lic is offended?. Just once, I?d like to meet some?one who was actu?ally an offi?cial part of the ?offended group? over a par?tic?u?lar gam?ing con?tro?versy, or was affected in some way by the things the media keeps telling us we should be upset about. Any?body? Anybody??

Now, I?m not say?ing that the peo?ple in the above exam?ples don?t have a right to express their opin?ions. The par?ents of Chris Stan?i?forth who died of DVT cer?tainly are right to grieve. Neil Sta?ples has every right (oblig?a?tion, even!) in the world to pro?tect his daugh?ter from harm. But what remains is the ques?tion of how to pro?ceed, and what we as gamers should take from these cases. As cit?i?zens, we have the duty to act in an eth?i?cal and respon?si?ble man?ner. We must not blame?the trou?bles that befall us as part of every?day life on the eas?i?est tar?get sim?ply for the sake of plac?ing blame. We must not yell ?Fire!? in a crowded the?ater. And we must not make gam?ing into the scape?goat for our poor health or lack of par?ent?ing. In other words, we need to take respon?si?bil?ity for our own actions and decisions.

Family members suspect drugs in 5 deaths

LAUREL, Ind.?? A driver in rural Indiana made a startling discovery, finding a young girl walking in the road, alone.

But what police found at the 4-year-old's home was even more disturbing: four people dead, at least some of them shot. A fifth person was dead on a nearby property.

Indiana State Police said autopsies were done Monday on four of the five victims, and they didn't plan to release the IDs until after the fifth autopsy is completed on Tuesday.

With few details released from authorities, residents were left speculating about what brought violence to their area about 50 miles southeast of Indianapolis ? and whether the danger had passed.

"People who haven't locked their doors in years, they're definitely locking up tight now," said Ryan Renfro, who lives nearby. "I actually took off work today because I'm here with my elderly grandparents and I didn't want to leave them here alone until they caught who they are looking for."

Sgt. Jerry Goodin, a spokesman for the Indiana State Police, did not say whether the shooter or shooters were believed to be among the deceased. He did say Monday that no manhunt was being conducted.

Although police weren't releasing the names, people in this area, where many are related by blood or through marriage, talked about their relatives who had been killed. Those included four members of one family ? a man, his estranged wife and their two adult children ? as well as a neighbor who had gone to visit a member of the household.

Jewel Compston said her son, Henry Smith, 43, left the house they share Sunday morning to go to the home where the four bodies were found.

"He never made it back," she said, tearing up.

Compston said police told her early Monday that Smith had been shot to death.

Smith's aunt, Evelyn Renfro, lives nearby and said she heard shots around noon Sunday.

"Nobody went out because they were loading the cattle here and they didn't pay no attention to that," Renfro said.

Police wouldn't comment on motive, but neighbors said they had complained about drug activity in the area, and the sister of one victim said the family had been involved with drugs.

Franklin County Sheriff Ken Murphy said his deputies have been to the address before but did not say whether drugs were involved.

Teresa Richardson said the home where the bodies were found belonged to her sister's estranged husband, who lived there with the couple's daughter and son. She said her sister was visiting them Sunday.

She said police called her Monday afternoon and confirmed the four dead inside the home were her sister, Angie Napier, her sister's estranged husband, Roy Napier, daughter Melissa Napier and son Jacob Napier.

Teresa Richardson called the deaths a "senseless massacre" and said she blamed it on drugs. She said her sister and Roy Napier would have arguments that sometimes got physical, but she didn't think any of the family members would have turned on the others.

Debra Richardson, who can see the home from the greenhouse at her Pretty Petals florist shop next to her house, said she has complained frequently to police about what she believed to be drug dealers in the area, including at the mobile home.

"I have a greenhouse business, and they had more traffic than I do. I'm in here working in the greenhouse and I see people pulling in all the time. You don't have that many people visit you."

A top restaurateur is throwing in the apron, saying he?s done with New York City because a wave of vicious lawsuits, coupled with draconian state regulations, threatens to cripple the industry.

Eateries have paid out close to $30 million in settlements over wage and tip complaints in the past few years ? and that?s just from suits filed by one Manhattan lawyer, Daniel Maimon Kirschenbaum.

The city?s biggest names, including Nobu, Jean Georges, Sparks and Mesa Grill, have forked over millions, and more restaurants are on the hook. The ?21? Club reached a tentative $2 million settlement last week in a suit that alleged it stiffed workers on overtime pay and did not properly distribute a service charge to banquet staff.

?Money-hungry lawyers, through frivolous lawsuits, are shaking down the very foundation of Manhattan?s restaurant industry,? fumed Joe Bastianich, co-owner of Eataly, Del Posto and Babbo.

Bastianich said the litigation ? he has been sued twice ? has left such a bitter taste that he?s done with setting up new ventures in New York.

?We opened Eataly and put 700 jobs in the New York economy. Since then we haven?t opened another restaurant in New York, nor will we,? Bastianich told The Post. ?We opened three other restaurants, in California and Connecticut, worth 1,000 jobs that could have been here in New York. Someone in Albany needs to understand the agenda, what this is really costing the greatest restaurant city in the world.?

New wage rules from the state Labor Department, which took effect in January, regulated tip distribution for the first time. For restaurant owners who lose their cases in court, the damages are now much harsher.

?You?re forced to settle. Why go to trial and risk a $5 million settlement if you can settle for a million and a half?? Bastianich said.

It seems as if none of the city?s eatery elite has been immune from litigation. Keith McNally settled for $1.48 million over claims at Pastis and Balthazar, and Laurent Tourondel spent $925,000 to end suits at his BLT empire.

The legal battles have led to some desperate moves.

Celebrity chef Geoffrey Zakarian filed for bankruptcy earlier this year, a move his publicist said at the time was because of the ?enormous costs of defending a class-action lawsuit by former employees? of Country, a now-shuttered restaurant.

Chris Cannon suddenly closed his highly rated Alto and Convivio restaurants last winter. Alto had been sued over an allegation the waitstaff was forced to illegally share tips with the general manager and other ineligible workers. He settled last month for $300,000.

The avalanche began five years ago as lawyers filed class-action cases drawing together busboys, waiters and other staff, sometimes by the hundreds. The more plaintiffs, the larger the potential settlement, with lawyers typically taking one-third of the payout.

?I invented this business,? said Kirschenbaum, a Manhattan lawyer who has launched more than 100 suits in federal court, including one against Bastianich and his partner Mario Batali.

The class-action suit claims the restaurant denied overtime to workers, didn?t pay a required premium for long shifts, and illegally kept a portion of tips.

Another suit, by a different lawyer, charges Bastianich and his partners failed to pay waiters and others minimum wage and overtime at Del Posto, where the seven-course tasting menu is $145. It also claims that the restaurant owners ?unlawfully retain gratuities added to banquet bills.?

?This is an industry where people thought they were getting away with stuff,? Kirschenbaum said. ?They alter time sheets. They get service employees to share their tips with kitchen staff to help pay their salary in the back of the restaurant.

?Restaurants have been getting away with this for a long time.?

But Bastianich maintains that workers in New York eateries are paid the ?best restaurant wages in the world.?

?Plaintiffs are waiters and busboys making 70, 80, $100,000 a year,? he said.

The issues stem from a competitive industry that deals largely in cash and where rules regarding salaries and tip distribution are complicated, said lawyer Louis Pechman, who won the largest settlement against a single restaurant ? a $3.15 million payment from Sparks steakhouse in 2009.

?The majority of restaurants on any given street in New York are still paying people the wrong way,? said Pechman, who sometimes teams up with Kirschenbaum.

Pechman runs a Web site called waiterpay.com that details restaurant pay rules and provides space for potential litigants to contact his firm.

Stephen Hans, a Long Island City-based lawyer who defends many small restaurants, said predatory lawyers even look for plaintiffs by advertising in El Diario and other ethnic newspapers.

Restaurants are often liable because they didn?t keep accurate records. He said one Queens pizzeria owner came to him with tears running down his face.

?He wasn?t keeping proper time records, so he didn?t have a defense,? Hans said. ?He had to pay damages. It just killed him.?

Carolyn Diane Richmond, who has defended Nobu, Tribeca Grill and other top eateries, said the suits are spreading to mom-and-pop operations.

?It?s been a recipe for disaster for many small operators,? Richmond said. ?There?s a perception, particularly in this city, that restaurateurs are sitting on gold mines.?

Restaurant owners often settle because they fear a worst-case scenario where they?re found to have violated the law, Richmond said.

The new state regulations spell out who?s in the tip pool, including waiters, busboys, bartenders and others as long as they regularly serve customers.

Typically, cash and credit-card tips are amassed and distributed to eligible staff based on a formula, with some workers getting a greater share.

If an unauthorized employee, such as a maitre d?, shares just once in the tip pool, the restaurant risks losing its so-called tip credit. That is the regulation that allows owners to pay tipped employees less than the minimum wage.

In New York, waitstaff can be paid $5 an hour, instead of $7.25, with the $2.25 difference considered the credit.

But a restaurant that is found to have violated the law, and loses the tip credit, must return the $2.25 an hour to every employee who worked during the period of the violation, for every shift they worked. This can add up to thousands of worker-hours.

?You?re talking potentially millions of dollars,? Richmond said.

The settlements, which usually come with no admission of wrongdoing, often don?t end up enriching waiters and busboys much.

In the case of the $2.5 million Nobu settlement, $833,333 went to Kirschenbaum?s and other firms. The 200 or so workers who sued got an average payment of $3,300 each.
